Nationals of countries that have a qualifying treaty with the U.S. may establish a business in the U.S. or be employed by a U.S. business that is owned by nationals of the same country. The E-1 visa is for a business engaged in substantial trade primarily between the U.S. and the treaty country. The E-2 visa is for a business in which the foreign owner has made a substantial investment. A principal investor must actively develop and direct the U.S. business, while an employee must work in an executive or supervisory capacity or one that involves special qualifications. E-1 or E-2 status may be valid up to 2 years and is renewable indefinitely. The following countries have the necessary treaties with the United States: |
